Modifications

Modifications are cases that arise from divorce and paternity actions. These occur when a party returns to court later on alleging that there are changes of circumstances on a substantial and recurring basis that demands or warrants a modification.  When a party files for modification, they are asking the court to change the current alimony, parental responsibility, Parenting Plan/time-sharing schedule and/or child support amount. A determination of parental responsibility, a Parenting Plan and a time-sharing schedule may not be modified without proof of substantial, material, and unanticipated change in circumstances and a determination that the modification is in the best interests of the children.
